SMS Consent & Messaging Terms

This page explains how Upscale Sites uses text messaging, how you agree to receive it, and how you stop it. Message and data rates may apply. Reply STOP to opt out, HELP for help.

Who is texting you

Text messages under these terms come from Upscale Sites, owned and operated by Md Rahman, based in New York. You can reach a person at hello@theupscalesites.com or (516) 515-1776.

Two different things are covered here, and it is worth keeping them apart. The first is messages we send you about your own enquiry or your account. The second is messages sent on behalf of a client business to that business's customers, using the missed-call text-back system we set up.

How you opt in

You opt in by doing one of these things. Nothing is pre-ticked, and no consent is assumed from a phone number alone.

  • Ticking the consent box on a form on this website and giving us your mobile number.
  • Texting us first at the number published on this website.
  • Telling us on a call or in writing that you would like updates by text, which we record.

Consent is not a condition of buying anything. You can send any form on this site, book a call, and become a client without ever agreeing to receive texts. If you skip the box, we will use email or the phone instead.

How your customers opt in

When we run missed-call text-back for a client business, the person receiving the text has called that business. The reply is sent to the number they called from, in direct response to that call, and it identifies the business by name.

Every one of those messages carries the business name and an instruction to reply STOP. A number that opts out is suppressed for that business and does not receive further automated messages.

What the messages are

Message frequency varies and depends on how often you contact us or how often someone calls the business. There is no recurring marketing blast, and we do not send promotional campaigns to lists.

  • A reply to a call that was not answered, asking what the caller needs.
  • A follow-up about an enquiry, a quote, or scheduling.
  • A request for a review after a job is finished, with a link to the business's public review page.
  • Occasional service notices about your own account, such as a site change going live.

How to stop

Reply STOP to any message and the messages end. You will get one confirmation that the opt-out was received, and after that nothing further.

Reply HELP to any message for contact details, or email hello@theupscalesites.com. You can also ask us to remove your number at any time by replying to any message or emailing us, and you do not have to give a reason.

Rates and carriers

Message and data rates may apply. Text messaging is billed by your mobile carrier under whatever plan you are on, and we have no control over and take no responsibility for those charges.

Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed, which is one of the reasons the system does not rely on a text alone for anything time-critical.

Your number

Mobile numbers and consent records collected for text messaging are not sold, rented, or shared with third parties for their own marketing. They are shared only with the messaging providers who deliver the messages on our behalf, and only for that purpose.

This sits alongside our privacy policy rather than replacing it. Where the two overlap, the privacy policy governs how information is stored and for how long.

Reply STOP to any message and it stops immediately. If you would rather just tell a person, email or use the contact page and it gets handled the same day.
